Installments Terms & Conditions

Approval of any application remains subject to BMS's assessment and approval procedures. These Terms should be read together with the Customer's individual Deferred Payment Agreement, payment schedule, application, and any other documents applicable to the transaction.

1. The Deferred Payment Program

The Deferred Payment Program allows eligible Customers to acquire an approved mobile device from the Seller and pay its agreed price through scheduled installments over an approved period.

The specific commercial terms applicable to each Customer, including the device, retail price, down payment, number of installments, installment amount, payment dates, and other applicable amounts, shall be stated in the Customer's individual Deferred Payment Agreement and payment schedule.

Submission of an application does not constitute approval or create an obligation upon the Seller to accept the Customer into the Deferred Payment Program.

2. Application and Eligibility

To apply, the Customer may be required to provide information and supporting documentation including, as applicable:

  • Full legal name;
  • National identity card or passport;
  • Date of birth;
  • Contact information;
  • Residential address;
  • Employment and income information;
  • Information concerning existing payment obligations;
  • References;
  • Supporting identification, employment, income, or residential documents; and
  • Any other information reasonably required to assess the application.

The Customer represents that all information and documentation submitted are true, complete, accurate, and current.

The Seller reserves the right to verify information supplied by the Customer and to request additional documentation or clarification before deciding on an application.

3. Application Assessment and Approval

Applications may be subject to an internal assessment process considering factors including identity verification, employment stability, payment capacity, residential stability, documentation quality, and fraud indicators.

Subject to applicable law, the Seller may approve an application, approve it subject to additional conditions, request additional verification or documentation, require additional security or a co-signer where applicable, or decline the application.

Approval of one application does not guarantee approval of any subsequent application.

4. Deferred Payment Terms

For every approved transaction, the Customer shall enter into an individual Deferred Payment Agreement specifying the applicable terms, which may include:

  • Device model and specifications;
  • IMEI and/or serial number;
  • Retail price;
  • Down payment;
  • Deferred Payment period;
  • Number of installments;
  • Monthly installment amount;
  • First installment due date; and
  • Subsequent installment due dates.

The Customer is responsible for reviewing these details before signing the Deferred Payment Agreement.

By signing the Agreement, the Customer confirms acceptance of the applicable payment schedule and undertakes to make each payment when due.

5. Payment Obligations

The Customer must make all scheduled payments in accordance with the dates and amounts specified in the Deferred Payment Agreement and payment schedule.

The Customer is responsible for ensuring that payments are made through an accepted payment method within the applicable payment period.

Payment obligations remain in effect notwithstanding temporary restriction of the device resulting from a default under the Agreement.

6. Ownership of the Device

The Customer acknowledges and agrees that legal ownership of the device remains vested in the Seller until all amounts due under the Deferred Payment Agreement have been paid in full and all contractual obligations have been satisfied.

Possession and use of the device by the Customer before final settlement do not constitute transfer of legal ownership.

Until ownership has transferred, the Customer may not sell, pledge, assign, transfer, dispose of, or otherwise create rights in favour of a third party over the device without the Seller's prior written consent.

Upon receipt of final payment and satisfaction of all contractual obligations, ownership of the device shall transfer to the Customer in accordance with the Deferred Payment Agreement.

7. Samsung Knox Guard

Where applicable, the Customer acknowledges and accepts that the device will be enrolled in Samsung Knox Guard during the Deferred Payment period.

The Customer agrees to comply with applicable Samsung Knox Guard terms and conditions in addition to these Terms and the individual Deferred Payment Agreement.

The Customer understands that Samsung Knox Guard provides device-management capabilities through which restrictions may be applied to the device in accordance with the Deferred Payment Agreement.

Such restrictions may include, where technically supported and applicable, application restrictions, temporary device restrictions, temporary device locking, or other device-management measures.

8. Tampering With Device Management

The Customer shall not attempt, directly or indirectly, to disable Samsung Knox Guard, remove the device from enrollment, circumvent or bypass device-management controls, alter the device for the purpose of defeating such controls, or permit another person to undertake such actions.

Any deliberate attempt to interfere with or circumvent the device-management system may constitute a material breach of the Deferred Payment Agreement.

9. Device Maintenance and Repair

During the Deferred Payment period, maintenance or repair that may interfere with Samsung Knox Guard or other device-management functionality should be performed through the Seller or through an appropriately authorized or approved service provider.

The Customer acknowledges that unauthorized intervention may affect the device, its data, warranty, or device-management status.

To the extent permitted by applicable law, the Seller shall not be responsible for damage, data loss, or other consequences resulting from unauthorized third-party intervention.

10. Payment Default

A payment shall be considered in default when it remains unpaid beyond the applicable contractual grace period.

In the event of default, and subject to the Deferred Payment Agreement and applicable law, the Seller may:

  • Issue payment reminders;
  • Contact the Customer concerning outstanding amounts;
  • Apply any contractually agreed charges or fees;
  • Initiate applicable collection procedures;
  • Initiate device-management restrictions through Samsung Knox Guard; and
  • Exercise other rights available under the Agreement or applicable law.

11. Device Restriction Following Default

Where the Customer is in payment default, the Seller may initiate restrictions on the device through Samsung Knox Guard in accordance with the Deferred Payment Agreement and applicable law.

Such restrictions may remain in effect until the relevant default has been remedied or the parties otherwise agree in writing.

Restoration of device functionality following payment may require a reasonable operational processing period.

Device restriction does not extinguish or reduce amounts otherwise due under the Deferred Payment Agreement.

12. Full Payment and Knox Guard Unenrollment

Once the Customer has paid all installments and other amounts due and satisfied all contractual obligations, the Seller shall arrange for the device to be unenrolled from Samsung Knox Guard within a reasonable operational period.

Following confirmation of full settlement, legal ownership of the device shall transfer to the Customer in accordance with the Deferred Payment Agreement.

13. Early Settlement

The Customer may request to settle all remaining amounts before the scheduled completion of the Deferred Payment period.

Any applicable early-settlement calculation or adjustment shall be determined in accordance with the Deferred Payment Agreement, the Seller's applicable policy, and applicable law.

Following confirmation of full early settlement, the provisions concerning transfer of ownership and Knox Guard unenrollment shall apply.

14. Events of Default

Events of default may include:

  • Failure to make scheduled payments and failure to remedy such non-payment within any applicable grace period;
  • Providing false, fraudulent, or materially misleading information;
  • Attempting to bypass, disable, remove, or interfere with Samsung Knox Guard;
  • Selling, transferring, pledging, or otherwise disposing of the device without the Seller's prior written approval before ownership has transferred; or
  • Any other material breach of the Deferred Payment Agreement.

15. Customer Information

The Customer undertakes to maintain accurate and current information throughout the Deferred Payment period and should promptly inform the Seller of material changes to their mobile number, residential address, email address, or other relevant contact information.

Failure to update such information does not relieve the Customer of contractual payment obligations.

16. Privacy and Personal Data

Personal information collected in connection with the Deferred Payment Program may be processed for application assessment, identity verification, fraud prevention, payment administration, collections, customer communication, device management, contractual administration, and legal or regulatory compliance.

Further information is provided in our Privacy Policy.

17. Device and Customer Data

The Customer remains responsible for the appropriate use, care, security, and protection of the device while it is in the Customer's possession.

The Customer is responsible for maintaining appropriate backups of personal data stored on the device.

Except where liability cannot legally be excluded or limited, the Seller shall not be responsible for Customer data loss resulting from unauthorized repair, tampering, misuse, or circumstances attributable to the Customer or an unauthorized third party.

18. Individual Deferred Payment Agreement

These Terms govern the general operation of the Deferred Payment Program.

Each approved transaction shall additionally be governed by an individual Deferred Payment Agreement between the Seller and the Customer containing transaction-specific information.

Where a conflict exists between these general Terms and the Customer's signed Deferred Payment Agreement, the signed Deferred Payment Agreement shall govern the specific transaction, subject to applicable law.

19. Changes to These Terms

The Seller may amend these website Terms from time to time to reflect changes in the Deferred Payment Program, technology, operational requirements, or applicable legal and regulatory requirements.

Such amendments shall not retrospectively alter the Customer's signed Deferred Payment Agreement except where permitted by that Agreement and applicable law.

The latest version shall be published on the website together with its effective or last-updated date.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lebanon.

Any dispute arising from or in connection with these Terms or the Deferred Payment Program shall be subject to the jurisdiction of the competent courts of Beirut, Lebanon, unless otherwise required by applicable law.

21. Acceptance

By submitting an application and, where approved, entering into a Deferred Payment Agreement, the Customer confirms that they have read and understood these Terms; provided true and accurate information; understood their payment obligations; understood that ownership remains with the Seller until full settlement; understood and accepted the use of Samsung Knox Guard where applicable; and agreed to comply with these Terms and the individual Deferred Payment Agreement.
